2.1 The Framework of Technical Engagement
By engaging TehzeebTech.online, the “Client” enters into the “Software Development Accord.” This contract governs the creation, licensing, and maintenance of custom-coded assets. In the absence of a signed physical Master Service Agreement (MSA), these digital terms serve as the binding legal framework for all “Sprints” and “Milestones.”
2.2 Intellectual Property (IP) & Code Ownership
- The “Transfer of Title” Clause: Upon 100% realization of the final payment, the Ownership of the Front-End Code and custom logic is transferred to the Client.
- The “Tehzeeb Core” Exception: Tehzeeb Tech retains ownership of our proprietary “Boilerplate” libraries, pre-written functions, and optimization scripts used to speed up development. The Client is granted a perpetual, non-exclusive license to use these “Core” elements as part of their project.
- Open-Source Disclosure: Projects utilizing open-source frameworks (React, Node.js, Python libraries) are subject to their respective licenses (MIT, Apache, etc.).
2.3 The Agile Sprint & Milestone Protocol
- The “Scope Creep” Amendment: Any request for functionality not defined in the initial “Requirement Traceability Matrix” (RTM) constitutes a “Change Request” (CR) and will be billed at our standard hourly developer rate.
- UAT (User Acceptance Testing): The Client has 14 business days to test a milestone. If no feedback is provided, the milestone is deemed “Technically Accepted” and billing proceeds.
2.4 Server Deployment & Hosting Liability
TehzeebTech.online is a development agency, not a hosting provider. While we assist in deployment, we are not liable for downtime caused by third-party server failures, domain expirations, or “Acts of God” (including regional internet blackouts or cable cuts).
